摘要
在风险社会背景下,责任伦理面向未来、强调整体、应对风险,能够为企业数据合规提供正当根据和观念指导。从事数据活动的企业须承担防范数据安全风险的伦理责任。在责任伦理视角下,基于企业单位刑事责任二元论,对企业合规刑事归责予以伦理评价。数据安全合规具有道德规范与法律规范“、软法”和“硬法”的伦理规范层次;责任伦理规范内容包括企业数据安全保障和个人数据权利保护两方面,可作为认定企业数据犯罪的前置法依据。数据安全刑事合规应秉持预防理念,从事前合规计划和事后合规整改两方面进行构建,企业能够获得刑事责任减免的合规效应,从而实现一般预防与特殊预防的结合。
In the context of risk society,responsibility ethics,which faces the future,emphasizes integrity and responds to risks,can provide legitimate basis and conceptual guidance for enterprise data compliance.Enterprises engaged in data activities must bear the ethical responsibility of preventing data security risks.From the perspective of responsibility ethics,based on the dualism of criminal responsibility of enterprise units,this paper gives an ethical evaluation on the criminal accountability of enterprise compliance.Data security compliance has the ethical level of moral and legal norms,“soft law”and“hard law”;The content of the code of ethics of responsibility includes two aspects:the security of enterprise data and the protection of personal data rights,which can be used as the pre legal basis for identifying enterprise data crimes.Criminal compliance of data security should adhere to the concept of prevention,and be constructed in two aspects:pre compliance plan and post compliance rectification.Enterprises can obtain the compliance effect of criminal liability relief,so as to realize the combination of general prevention and special prevention.
