摘要
当前电信网络诈骗犯罪呈现许多新的特点:作案手段与信息技术更迭轨迹同步、不断衍变翻新;犯罪地点由点向面扩散,向境外转移趋势明显;侵害对象从“普遍撒网”到“精准定制”再到“孵化培育”;犯罪主体逐步年轻化,犯罪组织从“作坊”进化为“公司”并形成“黑灰产业链”;受害群体遍布各阶层,犯罪数额急速增长。尽管打击此类犯罪取得了一定成效,但屡打屡犯、屡禁不止。打击治理电信网络诈骗犯罪,需坚持侦防结合,预防为主,创新侦防对策理论体系,改革侦查机制和迭代侦查手段技术。侦控方面,要建立侦控运作新机制,建设基层反诈技术生态,斩断相关黑灰产业链;预防方面,要严格落实法律要求,强化反诈预警机制,反诈宣传精准到位,以最大限度为平安中国、法治中国建设作出新贡献。
The current telecom network fraud crime presents many new characteristics:the crime means and information technology change track synchronization,constantly evolving renovation;The crime places spread from point to surface,and the trend of transferring abroad is obvious.The targets of infringement range from"general net casting"to"precise customization"and"incubation and cultivation".The subjects of crime are getting younger,and criminal organizations are evolving from"workshops"to"companies"and forming"black-gray industrial chains".The victimization groups spread across all classes,and the number of crimes increased rapidly.Although the crackdown on such crimes has achieved certain results,but repeatedly hit repeated offenders,repeatedly banned.To crack down on telecom network fraud,we should adhere to the combination of investigation and prevention,give priority to prevention,innovate the theoretical system of investigation and prevention countermeasures,reform the investigation mechanism and iteration of investigation techniques.In terms of investigation and control,it is necessary to establish a new mechanism of investigation and control operation,build a grassroots anti-fraud technology ecology,and cut off the relevant black-gray industry chain.In terms of prevention,it is necessary to strictly implement the legal requirements,strengthen the anti-fraud early warning mechanism,and promote anti-fraud accurately and in place,so as to make new contributions to the construction of a safe China and the rule of law in China to the greatest extent.
