摘要
当前我国高校法治工作已经取得了一定的成绩,但是依然存在法治工作重视程度不够、权利保护意识不强、风险管控规范质量不高和民法典学习不深等问题。中国民法典的颁布举世瞩目,在法治中国建设进程中具有里程碑式的意义。民法典新增条款对高校法治工作在人格尊严保护、个人信息保护、科研伦理底线、职务代理责任风险和法治思维等五个方面提出了新的要求。民法典实施后,高校法治工作要从深学民法典增强法治意识为起点,不断转变思维方式,建立健全师生人格权保护机制、不断强化科研伦理底线规范、全面规范合同管理制度,为推动高校治理体系和治理能力现代化、落实高校立德树人的根本任务贡献力量。
At present, the rule of law work in my country’s colleges and universities has achieved certain results, but there are still problems such as insufficient attention to the rule of law work, lack of awareness of rights protection, low quality of risk management and control regulations, and insufficient learning of the civil code. The promulgation of the Chinese Civil Code has attracted worldwide attention and has a milestone significance in the process of building the rule of law in China. The Civil Code poses new challenges to the rule of law work in universities in five aspects: the protection of personal dignity, the protection of personal information, the bottom line of scientific research ethics, the risk of job agency responsibility, and the rule of law thinking. In the era of civil code, the rule of law work in colleges and universities should start from deep learning of the civil code to enhance the awareness of the rule of law, establish and improve teacher and student privacy and personal information protection mechanisms, continue to strengthen scientific research ethical bottom line standards, and comprehensively standardize contract management system, and incorporate the Civil Code into the content system of the rule of law education at an appropriate time, contributing to the promotion of the modernization of the governance system and governance capabilities of colleges and universities, and the implementation of the fundamental tasks of morality and talent cultivation in colleges and universities.
