摘要
在全面依法治国背景下,通过系统梳理习近平总书记关于全民健身的重要论述,从宪法学视角探寻其中丰富的理论价值,厘清全民健身与体育强国、全民健康的关联。宪法国策条款是国家机关条款和权利义务条款之外的第3种类型,具有鲜明的指导作用,全民健身是实现体育国策条款“增强人民体质”的重要途径。习近平法治思想是全面依法治国的根本遵循和行动指南,全民健身隐含的法治密码与其核心要义不谋而合,如“党的领导”“以人民为中心”“依法行政”等。今后应该在习近平法治思想指引下,积极推进全民健身国家战略,为其提供坚强的法治保障。具体而言,需要明确体育权属于宪法性权利,全国人大及其常委会及时制定《全民健身法》,并提升全民健身治理能力现代化建设,如此方能取得预期成效行稳致远。
In the context of promoting law-based governance in China,this article summarizes President Xi Jinping’s important discussion on national fitness,and explores its theoretical value from a constitutional perspective to identify the relations among national fitness,building a leading sporting nation and national health.The constitutional clauses on state policies are the third category besides clauses on organs of state and those on rights and obligations,and therefore play a distinct guiding role.The national fitness campaign is an important approach to honoring the clause on the national policy of“building up people’s health”.President Xi’s thought on rule of law is the fundamentals of law-based governance;the code of rule of law implied by the nationwide fitness campaign is consistent with the core principles,such as“leadership by the Party”,“people-centered”,“administration according to law”and so on.Under the guidance of President Xi's thought on rule of law,we should promote the national strategy of national fitness and provide it with a strong legal basis.In the future,we need to make it clear that sports rights are constitutional rights.
