摘要
用地手续办理工作是大中型水电工程征地移民工作的重要组成部分,主要包括用地预审、用地手续报批(包含农用地转用审批、土地征收审批)和不动产登记三项工作内容。通过研究大中型水电工程涉及的主要土地工作与项目关系发现,严重存在在现行法律框架下的土地报批政策无法满足项目核准后在合法使用土地前提下尽快开工的情况。为了化解这一难题,维护和体现土地相关法律法规的权威,在保护耕地的前提下,最大程度减少违法用地现象,减少土地管理成本。笔者对现有土地报批政策的深入挖掘分析,找出问题症结点,提出两种审批程序的思路,供相关部门参考。
Application of land use permits is an important part of land acquisition and resettlement work of large and medium-sized hydropower projects.It mainly includes pre-examination of project land,land approval and real estate registration,among which the approval procedure involves agriculture land conversion and acquisition approval.Study on the relationship between land utilization and the project implementation shows that the applicable and approval policy under the current legal framework cannot meet the demand of prompt commencement upon approval of the project.In order to resolve this problem,maintain the authority of land-related laws and regulations,protect arable land,minimize illegal land use and reduce land management costs,the paper identifies the bottlenecks and proposes two thoughts of approval procedures for relevant departments'reference based on analysis of the existing land approval policies.
