摘要
刷单是伴随网络购物发展诞生的一种新型社会现象,它危害消费者利益,破坏市场公平竞争环境,不利于我国网络经济的可持续发展。要遏制刷单行为,应先厘清当前刷单行为的样态及所侵害的法益。可根据刷单行为的目的,将其分为财产型刷单、信誉型刷单两大类,有针对性地展开刑法评价。以消费者和第三方平台为对象的财产型刷单通常涉及诈骗罪,一般信誉型刷单可能涉及虚假广告罪。同时,即使当前网络刷单猖獗,亟需规制,但反向刷单行为和组建刷单炒信平台行为并不符合破坏生产经营罪、非法经营罪的构成要件,法院的判决有类推解释之嫌,应考虑适用损害商业信誉、商品声誉罪及网络犯罪的有关规定。
Click farming is a new social phenomenon born with the development of online shopping.It endangers the interests of consumers,destroys the fair competition environment of the market,and is not conducive to the sustainable development of our economy.In order to curb the click farming behavior,we should first clarify the form of it and the infringed legal interests.According to the purpose of click farming,it can be divided into two categories:property click farming and credit click farming,which help the criminal law evaluation to be carried out in a targeted way.Property click farming,which takes consumers and third-party platforms as the object,usually involves the crime of fraud,while the general credit click farming may involve the crime of false advertising.At the same time,even if the click farming behavior needs to be regulated urgently,the reverse click farming and the establishment of the click farming platform do not conform to the constitutive requirements of the crime of destroying production and operation as well as the crime of illegal business operation.The judgment of the court has the suspicion of analogical interpretation,so we should consider the application of the relevant provisions of the crime of damaging goodwill and commodity reputation,and network crime.
