摘要
依现有著作权法的版权法理基础确认人工智能创作物的版权,不仅法律制度上存在障碍,而且还会导致版权市场的混乱,因此,有必要探讨人工智能创作物的版权法理基础,并在此基础上确立调整人工智能创作物的版权法律制度,维护人工智能创作物的版权市场秩序。考察纯人类创作作品的版权法理基础以及人工智能创作物作为版权对象物的生成过程,人工智能创作物的版权法理基础为:以"人机合作"为基础的原始著作权人思想或情感的有限与创新性表达。
Not only there are obstacles in the legal system according to the existing copyright legal principle basis to confirm the copyright of the artificial intelligence creation,but also it leads to confusion in the copyright market itself,so it is necessary to explore the legal principle basis of the copyright of the artificial intelligence creation,to establish the legal system of adjusting the copyright of the artificial intelligence creation and maintain the order of the copyright market of the artificial intelligence creation. Sticking to the legal principle basis of copyright of the pure human works and the process of the creation of the artificial intelligence creation as the copyright object,the legal principle basis for the copyright of artificial intelligence creation is the limited and innovative expression of the original copyright owner’s thoughts or emotions on the basis of the" man-machine cooperation".
