摘要
在死因不明或对死因有异议的医疗损害责任纠纷案件中,尸检是明确死因的“金标准”,对推动医疗损害司法鉴定以及解决医疗损害责任纠纷具有重要意义。本文针对某市中级人民法院二审审结的78件医疗损害责任纠纷案的尸检率、死因认可情况、是否尸检及其对医疗损害司法鉴定的影响,以及影响尸检启动程序的相关成因作具体分析,进而提出相关改善建议。
In medical damage liability disputes in which the cause of death is unknown or the cause of death is disputed,autopsies are the"gold standard"to clarify the cause of death,which is of great significance to promote the judicial identification of medical damage and solve the dispute of medical damage liability.This paper mainly analyzes the rate of autopsies,the approval of death causes,the influence of autopsies on the judicial identification of medical damage,and the analysis on related causes affecting the initiation procedure of autopsies of 78 cases of medical damage liability disputes at the end of the second instance of the Intermediate people's court in a city,and puts forward some suggestions for improvement.
