摘要
在“专利爆炸”的背景下,专利丛林将阻碍创新的问题引起各国政府和学者们的广泛关注。本文以245篇英文文献为样本,系统分析了专利丛林的概念内涵、测量、产生原因、危害和解决机制。专利丛林的本质在于,特定技术领域的互补性专利被不同权利人分别所有。专利丛林现象深受一个国家的专利制度、创新模式和企业行为的影响。不同国家和不同技术领域的专利丛林并不相同。针对我国研究现状,本文指出我国专利丛林理论研究的方向:深入理解专利丛林内涵,加强专利丛林实证研究,有针对性地提出专利丛林解决机制。
Against the backdrop of “patent explosion”, the problem of patent thicket may endanger innovation. This issue raises extensive concern from governments and academia. Based on 245 reference literature published in English, the paper systematically analyzes the connotation, measurement, causation, harms and settlement mechanism of patent thickets. The nature of patent thicket lies in the separate owning of complementary patents in certain technical fields. The patent thicket phenomenon is deeply in fluenced by a country s patent system, innovation model and enterprise behavior. Patent thicket in different countries and different technical fields are inconsistent. In view of the current research level in China, the paper points out the future theoretical research direction on patent thicket in china, i.e. deeply understanding the connotation of patent thicket, strengthening the empirical research of patent thicket, and proposing speci fic patent thickets solution mechanism.
