摘要
在现代社会,复杂性增长与社会加速是两个引人注目的时空现象,而这种现象部分由科技革命所引发,并进一步带来了法律变革。复杂性增长造成法律及其诉讼爆炸式增长、信息超载、功能分化与风险剧增,这导致法律不得不以增加自身复杂性的方式降低外部环境的复杂性。而社会加速则带来法律在时间处理方面的四个难题,分别是稳定规范性期待难度加大,系统时间感受环境压力增加,司法决断时间压力增大以及立法作为时间调节器功能的不足。法律能否成为减速机制,从而减缓时间加速带来的人的异化,正在成为严峻的问题。科技革命与法律演化的关系暗含着在后人类境况下,需要对人的存在问题加以反思,后人类境况绝非意味着对既有人文主义思想遗产的否弃,更不意味着走向反人类的绝境,而是在兼容意义与功能、人文与科技的前提下,实现文明的第二次轴心突破。
In modern society,the growth of complexity and the acceleration of society are two noticeable phenomena of time and space,partly caused by the scientific and technological revolution and followed by further legal changes.The increase of complexity results in explosion of litigation and law,information overload,functional differentiation and increasing risks,while social acceleration brings four challenges in time processing of law,namely,increasing difficulty of stabilizing normative expectation,increasing pressure of system time from environment,increasing pressure of time toward judicial decision,and inadequate function of legislation as time regulator.The relationship between scientific and technological revolution and legal evolution implies that in the post-human situation,we need to rethink the existence of mankind.
