摘要
《行政处罚法》将过罚相当原则确定为行政处罚领域的基本原则,但未明确判断行政行为是否符合过罚相当的认定标准,过罚相当原则与作为行政法基本原则的比例原则的关系尚不明晰。通过"杭州最优炒货店案"引出过罚相当原则,指出过罚相当原则是比例原则的具体体现,比例原则是过罚相当原则的判断标准。可以从适当性、必要性、均衡性这三个比例原则的子原则认定是否符合过罚相当原则。通过司法案例归纳出主观过错程度、后果的严重程度、处罚的种类和幅度等过罚相当的裁判规则。
The“Administrative Punishment Law”establishes the principle of excessive punishment as a basic principle in the field of administrative punishment.However,it has not clearly judged whether an administrative act meets the criteria for determining excessive penalty or not.The relationship between the principle of excessive punishment and the principle of proportionality as the basic principle of administrative law is still not clear.Through the case of the best nuts store of Hangzhou,the principle of commensurate punishment has been drawn.It is pointed out that the principle of excessive punishment is a concrete embodiment of the principle of proportionality,and the principle of proportionality is the criterion for judging the excessive punishment.It can be judged from the sub-principles of the three proportional principles of appropriateness,necessity and balance.Judicial cases can be used to summarize judgment rules that are equivalent to commensurate punishment.
