摘要
从抵押品功能的视角,农地经营权抵押贷款可以分为"直接型"和"间接型"两种模式。在当前法律环境和产权制度约束下,农地经营权可抵押性不足,出于应付政绩考核压力以及规避风险的需要,开展"间接型"农地经营权抵押贷款成为大部分试点地区金融机构的理性选择。从江苏的实践来看,实行"直接型"模式需要试点地区具备较高的经济发展水平、规模较大的农业生产经营主体、成熟的农村金融市场以及较强的地方政府财政实力等条件。在中国农村土地制度改革的背景下,农地经营权抵押贷款试点应该分阶段逐步推进,应鼓励不同经济发展水平的试点地区因地制宜地开展不同类型的试点模式。
From the perspective of collateral function,land using right mortgage loan can be divided into'direct'and'indirect'modes. Under the constraint of the current legal and property right system,in order to meet the administrative assessment and avoid risk,the'indirect'land using right mortgage loan has been a rational choice to the financial institutions in most of the experimental areas. Based on the practice in Jiangsu Province,a high level of rural economic development,large-scale agricultural production and business operation entities,developed rural financial markets and strong local government finance are required to carry out the'direct'mode. The experiment of land using right mortgage loan should be deepened gradually and step by step under the background of China 's rural land system reform. Different modes are encouraged in experimental areas with different levels of economic development.
