摘要
承包经营权在外部环境、产权关系和权利主体层面均受制于国家战略管制、集体治理场域和亲缘地缘关系,表现出极强的社会关联性和复杂性。综合考量承包经营权制度变迁的需求和风险,承包经营权有偿退出制度改革需要从以下四个方面入手:建立集体成员身份进入和退出机制,筹建农民权益维护组织,完善农村土地的用益物权,推进农村土地承包经营权市场化退出的渐进式改革。
The contractual management rights shows strong social relevance and complexity, because the realization of rights is subject to the national strategic regulation in the external environment, to the collective management field in the relationship of property rights, to the genetic and geographical relationship in the aspect of right subjects. Considering the demand and risk of institutional evo- lution, we strongly suggest that the system reform of rural land contractual management rights＇ exit with compensation starts with the fol- lowing aspects： establishment of enter and exit mechanism of collective membership; construction of farmers＇ rights protection associa- tions ; perfection of the contractual management rights as a usufruct; gradual reform of market exit mechanism.
