摘要
针对公众参与环境治理,学者们提出了众多参与模式。通过对不同模式的理念、制度设计和具体操作三个方面进行对比,发现中国环境治理中存在着政府对公众不信任的境况。在当前政府主导环境治理的语境下,其他参与主体能否参与进来,以及在治理中处于何种地位由政府给予其的信任程度所决定。因此文章建议政府应从信息公开制度、公众参与决策制度和司法补救制度等方面增进对公众的信任;而公众则应提高参与的专业化与组织化,赢得政府信任。只有政府和公众共同努力,才能消弭政府对公众在环境治理中的不信任状况。
Many modes of Public participation have been put forward by the scholars concerning environmental governance. Having compared such aspects as concept, systematic design and operation of the different modes in the field, it is found that there has been distrust of the government towards the public. In the context of government- leading mode in China, the participation of other subjects and their role is to great extent relied on the trust of the government. It is therefore anism concerning decision suggested that the countermeasures regarding governmental information disclosure, mech- making and judicial remedy system should be adopted. Meanwhile, the public should be devoted to promote the specialization and organization in the process of participation. Only through the the joint ef- forts of the ~overnment and the public can the trust in such area be eliminated.
