摘要
自贾谊在《过秦论》中对秦亡的原因论述后,世人一直有着"秦亡于法家"的悖论,但是从相关史籍看,秦朝在政治、经济、法律及文化等方面均未遵循法家的主要思想。如果非说法家有错的话,那么错就错在法家没有让秦王遵循法家的思想。秦朝的灭亡,不是一个原因的结果,而是众多因素的合力使然:直接原因是农民起义;间接原因是酷刑厉法,这里所谓的酷刑厉法不是法家的重刑思想;根本原因是秦王基于穷奢极欲而繁徭重赋,致使人民无法生存。
Since JIA Yi discusses in his book the cause of the Qin dynasty perish,and people have always had the misunderstanding that is the Qin Dynasty perish is legalism ＇mistake. But by querying the related history know that this is not the case. The Qin Dynasty has not been following the main ideas of legalism in terms of political,economic,legal,cultural aspects. If the legalism has a fault,then the error is legalism didn＇t have the ability to let the king of Qin comply with the legalism‘s thought. The result of the Qin Dynasty＇s perish is not a cause but due to many factors. The direct reason is the peasant uprising. The indirect reason is torture punishments and harsh laws. Above the so- called torture punishments and harsh laws are not legalist thought. The root cause is that the king of Qin implements numerous corvee and heavy taxes because of lust,which people can＇t live.
