摘要
本文以"微信"商标行政案提出的典型法律适用问题为切入点,以体系解释方法对《商标法》第8条及其与相关法条的适用关系进行了探讨,重点就《商标法》有关商标可注册性规定的相关法条之间的内在联系及相关规定的准确适用问题进行了分析。本文立足于商标及商标权的本质属性,就商标的区别能力、区别能力与显著性、先申请意义和先申请利益、消费者利益与公共利益、"不良影响"及其他禁用规定的解释等问题,进行了较为深入的探讨。本文结合"微信"商标行政案的裁判,对于商标案件的裁判思路和方法也进行了研究。
This article starts from the typical law application issue raised by "WeChat" trademark administrative case, discusses on the application relationship between article 8 and related articles of Trademark Law through systematic explanation method, analyzes especially on the intrinsic link among the articles of Trademark Law concerned with registrability and the appropriate application of related rules. This article further discusses on the distinguish ability of trademark, distinguish ability and significance, the importance and interest of prior application, Consumer interest and the public interest, the interpretation of "adverse effects" and other prohibitions, and studies on the ideas and methods of the judgment of trademark case based on "WeChat" trademark administrative case.
