摘要
立功作为一个重要的法定从宽情节,其认定应该严格依据法律规定来进行。若是有证据证明线索来源系非法或者正当,立功的司法认定都不存在问题,但是在实践中,却经常发现线索的来源无法进行调查核实的情况,这就给司法机关认定立功带来了疑难。针对实践中存在"有利于被告人"原则在立功认定中的滥用现象,引入立功的构成理论来解决这一问题,以期有利于解决线索来源查证对立功认定的影响问题。
As an important legal leniency plot, the identification of merit should be carried out strictly in accordance with the law. If there is evidence to prove the source of clues illegal or legitimate, there will be no problem in the identification of merit, but in practice, there are often situations unable to investigate and verify the source of clues, which has brought difficulties to the judiciary to identify merits. For the abuse of the principle of ＂in favor of the defendant＂ in identifying the merit, introduce the constituted theory of merit to solve this problem, in order to solve the impact of verifying tentative clues to the identification of merit.
