摘要
作为近代中国第一个行政审判机构,北洋政府平政院在制度设计上既移植德、日行政审判体制,又遗存传统"民告官"救济途径。进一步以《平政院裁决录存》为基本素材考察民初行政审判实践,可以发现,平政院裁决书和原被告诉辩书中随处可见尊卑森严的行文用语;原告不服官署处分维护自身权益,需要经过逐级申控的诉愿程序;被告官署和平政院在处理纠纷之际,时常流露贱讼轻诉的诉讼心态;平政院为实现协和官民的治理目标,常常采用恩威并施的处理策略。这些方面构成了民初行政审判实践中的"民告官"底色,并与民初平政院制度设计上的"民告官"遗存一道,凸显了包括平政院法政人在内的民初法政精英整合治理资源、因应时代变革的努力。
As the first administrative judicial institution in modern China,the Beiyang Government’s Ping Zheng Yuan learned the administrative adjudication system from Germany and Japan,at the same time,it kept the"people suing the officials"relief route. On this basis,looking further into Ping Zheng Yuan’s trial practice in the early years of the People’s Republic of China by focusing on the Ping Zheng Yuan’s Judgments Collection,one could easily find the language was dignified. If the plaintiff refuses to take disciplinary action against his own rights and interests,he shall go through the procedure of petition which is controlled by the authority. At the time of the dispute,the court always reveal despise to the litigant mentality of the case. Ping Zheng Yuan often adopt the treatment strategy of kindness and threat to achieve the governance objectives that harmonic the concomitant and the people. These aspects constitute the background of the"people suing the officials"in administrative trial practice in the early ROC.,and with this system remains,it highlights Ping Zheng Yuan’s efforts,significance and limitations in the early days of integrated management of resources,in accordance to the times change.
