摘要
知识产权法制是保护科学技术和文化艺术成果、保证社会主义市场经济正常运行的重要法律制度,对于促进我国科学技术进步、文化繁荣和经济发展具有重要的意义。随着中国近年来创意产业的扩大发展,珠宝首饰的销量激增,然而在珠宝首饰设计领域,知识产权的侵权现象较为严重,其中主要包括珠宝设计稿和首饰产品两方面的抄袭。通过对这一现象进行分析,并结合发达国家沿用的知识产权的维权方式,提出促进中国珠宝首饰行业良性发展的相关知识产权优化理念,同时对于企业已经面临的设计侵权,提供可参考措施,促进原创设计为中国创意产业的可持续发展提供助力。
Legal system of intelletual property is a crucial law which protects products of sclentitic technology and art, to ensure the operation of socialist economic market, and it also plays a significant role in promoting the advancement of our nation＇s scientific technology, cultural prosperity and progression of economical development. While China＇s recent creative industry is expanding, jewelry sales are surging, in the field of jewelry design, infringement of intellectual property rights become more serious. Through the analysis of such phenomenon, along with developed countries＇ intellectual property rights and its means of protection, this article will make a proposal on optimizing some intellectual property rights that will fit Chinese jewelry industry and its developing trend. Besides, it will bing solutions to the design piracy for the jewelry companies, and make original designs provide references to the sustainable development of Chinese creative industry.
