摘要
预付费消费合同指在消费市场中,消费者根据经营者提供的营销内容,与经营者订立的先交付费用,后获得商品或服务并进行结算的合同。近年我国消费市场中,预付费消费合同纠纷呈多样化发展,消费者相关投诉呈上升趋势。反映出现有法律规制不足,消费者承担过大的法律风险,并在交易中弱势地位明显等问题。应当在立法中明确预付费消费合同的法律地位,强化对预付费合同格式条款的法律调控,完善消费信用安全的法律监管机制。
Pre-paid consumption contract refers to consumers according to marketing content,which formulated by the operators in the market,pre-paid and then get the product or service.Recent years,pre-paid consumption contract is used frequently in China's consumers market.But consumers are dissatisfied with this form of transaction.Inadequate legislation leads to consumers'consumption risks,and weak position in the transaction.So there is an urgent need to improve the legal and regulation,strengthen the regulation of the standard form contract and the mechanism of credit system.
