摘要
人大监督制度的运行失灵是社会与国家之间的力量对比失衡在政治制度中的现实反映。要想改变这种状态仅仅通过制度的赋权或者监督程序的规范是不现实的。社会自身发育不良或者自治能力欠缺都会导致对权力的严重依赖,进而丧失监督权力滥用的动力与力量。只有改革税制结构,提高公民政治参与能力,才可以为人大监督提供足够的动力源泉与力量支撑,并通过改善执政党的社会沟通机制为人大监督提供动力转换,才能在根本上摆脱监督乏力的困境。
The malfunction of the NPC＇ s supervision system is the result of strength imbalance between society and state in political pattern. It is unrealistic to change the situation only by increasing supervision power and standardizing supervision process. The maldevelopment of society and the absence of self-governance will lead to heavy dependence upon political power and lost supervision motivation to control power abuse. Only taxation structure reformation, enhanced civil competence in political participation and the improvement of ruling party＇ s social communication mechanism can provide and transmit sufficient drive and supporting strength for the NPC＇ s supervision and completely break the system away from malfunction.
