摘要
"小产权房"搅乱了房地产市场秩序,并造成利益分配的不公平。不过,"小产权房"的出现有着复杂的经济、社会、法律原因。如果仅仅为了消除违法性而对"小产权房"一拆了之,势必会造成更为严重的利益混乱,甚至有可能影响到社会稳定。考虑到公租房政策实施过程中的种种不足,"小产权房"在保障住房权利方面的社会功能应该得到肯定。在当前的法律背景下,我们可以将"小产权房"改造为公租房,从而建立集体公租房制度。这无论在市场机制的维护方面,还是在各方利益的平衡方面,都应该是现实的最优制度选择。
The "small property room"(SPR) has disturbed the order of real estate market, and Caused the unfairness. However, this problem has complex economic, social and legal reasons. If only to eliminate the illegality and demolish SPR, it will resuh in more serious interest confusion, and even affect social stability. Considering shortcomings of public rental housing (PRH) , the social func- tion of SPR in the housing rights protection should be affirmed. In the current legal context, we can reconstruct SPR into PRH, and es- tablish the system of collective public rental housing (CPRH). CPRH should be realistic optimal system selection. It will not only maintain of market mechanism, but also balance the interests of all parties.
