摘要
研究目的:对土地利用规划中的公权力、私权利的制约与保障展开理论分析和应用研究。研究方法:理论性演绎分析和针对性实证分析。研究结果:从公权力、私权利的制约与保障视角研究土地利用规划不仅必要而且可行,并具有重要的理论和实践价值。研究结论:(1)公权力、私权利的制约与保障是土地利用规划的重要内容,具体包括规划公权力与土地利用私权利的来源与依据、界限和范围、相互关系、冲突与救济等问题;(2)中国的土地利用规划存在规划公权力过于强势和土地利用私权利保障不足等问题;(3)未来中国土地利用规划理论中应加强人人关系协调尤其是权利的制约与保障等研究,实践中则应开展规划公权力的约束和土地利用私权利的保障等方面的制度创新与政策改进。
The purpose of the paper is to theoretically analyze the constraints and guarantees of public power and private rights in land use planning. The methods used include theoretical deduction and empirical studies. The results show that it is not only necessary but also feasible to study land use planning in terms of the constraints and guarantees of public power and private rights. It is concluded that the constraints and guarantees of public power and private rights are the main contents of land use planning. There are problems in current land use planning in China, such as the public power of planning is too strong and the private rights of land use are inadequately protected. Thus, theoretical research of interpersonal relationships in land use planning should be strengthened especially regarding the constraints and guarantees of public power and private rights issues. The institutional innovation and policy improvement should be carried out in practice on constraining the public planning power and protecting the private land use rights.
