摘要
《物权法》第五章关于农民集体所有权的规定涉及村民自治的有第59条、第60条、第62条和第63条,这些规定涉及集体成员的表决权、知情权和撤销权。以民主选举、民主决策、民主管理和民主监督为主要内容的村民自治法律需要进一步完善,与《物权法》衔接、配合,方能更好地发挥集体财产的效用,保护集体财产权利。
The collective ownership of farmers in Chapter V in ＂Property Law＂ related to farmers＇ self- government in article 59, article 60, article 62 and article 63, these provisions related to collective members＇ voting right, knowing right and withdrawing right. Democratic elections, democratic decision, democratic management and democratic supervision as the main content of village autonomy laws need to be further improved, and convergent with ＂Property Law＂ in order to play the effectiveness of collective property well, and protect the collective property rights.
