Research on the Basic Issues about the Exceptions of Technical Measure Circumvention Applicable to the Library

摘要利用著作权法律赋予图书馆可享有的技术措施规避例外,图书馆就能够更为方便地利用版权数字作品提供信息服务。文章分析了技术措施的边界和法律地位,指出技术措施规避例外存在的必要性、依据和原则,介绍主要地区、国家著作权法律关于技术措施规避例外的规定。在此基础上,界定图书馆可适用的技术措施规避例外,并剖析适用于图书馆的技术措施规避对图书馆的影响。 With the help of the copyright law that endows the library with the exceptions of technical measure circumvention, the library can use the copyrighted digital works to provide information service more conveniently. This paper analyzes the boundary and legal status of the technical measures, points out the necessity, foundation and principles of the exceptions of technical measure circumvention, and introduces the provisions for the exceptions of technical measure circumvention in the copyright law in the main countries and regions. On this basis, the paper de- fines the boundary of the exceptions of technical measure circumvention applicable to the library and anatomizes the influence of the exceptions of technical measure circumvention applicable to the library on the library.
