从个人权利到社会责任——对我国《食品安全法》的整体主义解释 被引量:29

摘要 造成巨大社会损害的"三鹿"事件及由此催生的《食品安全法》对既有的法观念和法律制度提出了挑战,以整体主义观念解读,其最根本的变化就是从既有法以个体权利为中心转向以个体对社会责任为中心。作为一种法律责任的社会责任既包括积极的、面向未来的"预设责任",也包括消极的、面向过去的,即对已发生的有害行为制裁的"过去责任"。其本质特性在于:它是所有主体都负有的责任,即是人人负有责任;是所有主体在秩序建构中的责任;是所有主体,即人人都可追究的责任。 Considering the legal concepts and legal institution that have experienced the notorious Sanlu poisonous milk event and the birth of the Food Safety Act of the PRC with a holistic view, one can find that the greatest evolution is that they have transformed from individual rights orientation to individual' s accountable to society. As a legal responsibility, social responsibility embraces not only the positive and supposed "forwardplanning responsibility" but also the negative and retrospective "past liability" tending to punish the undesirable acts that have done. The essence lies in that any and all people are subject to the responsibility in the establishment of the order and any and all people may seek to investigate and affix it.
