摘要
《治安管理处罚法》中一部分法条在内容上的规定与《刑法》的规定出现了法条竟合的关系,如何处理好《治安管理处罚法》和《刑法》的衔接,一些违法行为的规定与《刑法》规定的一些犯罪行为相竞合,公安机关检察机关对法条竞合的违法行为、犯罪行为如何甄别是值得探究的。
There exists concurrence of articles in Law on Penalties for Administration of Public Security and Criminal Law, which appears as overlaps of the illegal act and the criminal behavior. How to deal with the connection of these two pieces of legislation, which means how to deal with overlaps of the illegal act and the criminal behavior by public security organs, is a deserving research.
