摘要 农村宅基地使用权属于用益物权的范畴,是指他人为了自建房屋,占有、使用集体土地的权利。宅基地使用权的申请取得是基于村民身份,与集体成员权密不可分,也可以通过继承、买卖、赠与等流转方式取得。政府要对宅基地取得过程中的行为加强监管,既要保障村民合理使用宅基地的需要,又要防止宅基地过分扩张而损害社会公共利益。 The use right of rural housing estate belonging to the scope of usufructuary right means others who process and use collective land rights to self-buih houses. The application of the use right of rural housing estate is based on the villager's status and the right of collective membership, which can also acquisition through ways of circulation, such as inheritance, sale, grant and so on.. The government must strengthen supervision during circulation to prevent villager's reasonable needs and prevent social public interest from damage of expanding excessively homestead
