摘要
产品侵权是一种特殊的侵权行为，应适用严格责任原则。本文通过对严格责任的渊源、现实意义、与无过错责任的区别、在产品侵权责任中的适用，以及对“三鹿奶粉”个案等进行探讨，说明了我国侵权行为法中产品侵权采用严格责任原则更具有合理性。
The product infringement is a special tort infringement, which is applied to the principle of strict liability. Based on the strict liability of the origin, relevance, and the difference between no - fault liability, tort liability in product application, as well as the ＂Sanlu milk powder＂, this paper discussed the cases on violations of products infringing, and show the law to adopt the principle of strict liability are more reasonable.
