摘要
船舶压载水造成海洋外来生物入侵所导致的巨大危害,已经日益引起国际社会的广泛关注。本文在解析国际海事组织《控制和管理国际船舶压载水和沉积物国际公约》以及相关国家立法的基础上,通过剖析我国船舶压载水管理立法的缺陷和不足,提出从强调生态效益优先立法理念,突出法律规范内容特点和探索民事赔偿社会化途径等几方面,构建我国船舶压载水排放造成海洋外来生物入侵的法律防控机制。
More and more attention has been paid to the harmful impacts caused by the nonindigenous marine nuisance via ship' s ballast water. Based upon the International Convention for the Control and Management of Ship' s Ballast Water and Sediments developed by IMO and the related legislations in USA and Australia, the shortcomings and defects of legislations on ballast ;water management in China was deeply analyzed. By means of emphasizing the priority of ecological benefits, highlighting the characters of the content of lawful regulations and exploring the socialization of civil damage compensation, lawful preventing and controlling mechanisms on the management of ship' s ballast was put forward aiming to minimize the introduction of invasive organisms.
