Abstract In this article we briefly studied the fictitious domain methods for steady and nonsteady Navier-Stokes equations based on Penalty factorεon the extended domain. The convergence u<sup>?</sup>→u in H<sub>0</sub><sup>1</sup>(Ω)<sup>d</sup> and L<sup>2</sup>(Ω)<sup>d</sup>(d=2,3) is given as well as p<sup>?</sup>→p in L<sub>0</sub><sup>2</sup>(Ω).
