摘要
公共资金援助是金融危机救助法律制度中不可或缺的重整措施和制度安排。全文在比较分析欧美等发达国家公共资金援助制度的基础上,提出完善我国金融危机公共救助法律制度的具体建议:公共资金援助授予条件必须建立在客观标准之上,坚持最小成本原则,政治因素绝不能作为救助问题金融机构的借口和理由,同时有必要建立合理的公共资金救助成本分担机制。
Public fund bailout is an indispensable measure and arrangement in financial crisis bailout legal system. The article compares foundations of national public fund bailout systems in U.S. and European countries, and brings out concrete suggestions on reforming China＇s financial crisis bailout legal system. Public fund bailout endowment should be screened on objective standards and stick to minimum cost principle. It also needs to build a considerable cost share mechanism.
