摘要
囿于行政权的区域性配置,跨区域行政任务需要借助行政协助来实现。在我国相关立法未臻完善的背景下,行政协助往往因缺乏制度的保障而流于松散、临时或不稳定;加之地方利益分立化形成的地方保护主义,使得其制度功能的发挥备受制肘。行政协议作为行政主体之间的契约制度,导入到行政协助中,以约定义务替代飘忽的法定义务来约束行政协助当事人,最大限度地促使行政协助发挥作用,还原制度的应有功能。当然,作为职权行为,行政协助协议化的适法性亦需关注与论证;而协议化效果的实现则需要依赖区域法制协调的系统化。
Because of the regional distribution of administrative powers,administrative assistance is the necessary auxiliary system to fulfill the cross-regional administrative tasks.The imperfect legislation and local protectionism,however,which lead to malfunction of administrative assistance system.The administrative agreements may remedies the problem,which could restricts bodies of administrative assistance through agreed obligation instead of mandatory obligation,and realizes the function of administrative assistance.As an agency action,it is necessary to demonstrate the validity of administrative agreements that enters into administrative assistance;and realization of the intention talk above,needs to rely on the systematization of cross-regional legal co-ordination.
