摘要
在保险营销员与保险公司之间的关系的判断上,应从两个角度出发:一是从法律关系的本质而非合同的名称出发,查明二者之间的关系是否存在从属性,如果存在从属性,则应认定为劳动关系。二是从法律关系的内容出发.查明劳务给付是否为合同的目的,劳务提供者是否对于劳动事务有较大之自主裁量权,如果仅以劳务给付为合同的目的,且劳务提供者对劳动事务缺乏自主裁量权,则可认定为劳动关系,否则可认定为代理关系。因此,对从事保险营销的人员进行"劳务过程"的管理,还是对其进行"劳务成果"的考评,是劳动关系与代理关系在法律上的根本区别。
The relationship between individual insurance agents and insurance companies should be judged from two aspects. First, it should be judged from the nature of the relationship rather than the legal name of the contract. The existence of an affiliation relationship will demonstrate the existence of employment relationship or labor relationship. Second, the content of the legal relationship should be checked. If the in-work payment is the only purpose of the contract and labor providers have few discretions on labor affairs, the relationship can also be recognized as employment relationship or labor relationship in contrast to the agency relationship. The fundamental legal distinction between agency relationship and labor relationship lies on the management of"the labor process" or its"labor achievements"of the individual insurance agents.
