摘要
刑罚轻缓化作为一种轻缓的刑事政策,日益受到世界各国的青睐。刑罚轻缓化的正当性根据包括理论根据和现实根据,理论根据是指刑罚的人道性、刑罚的谦抑性和有限性;现实根据是指发达的经济基础、政治国家与市民社会相分离的二元社会结构基础和先进的社会文化基础。
The mitigation of penalty, as a landing gear of the criminal policy, is increasingly favored by various countries in the world. The justness basis for the mitigation of penalty includes theoretical basis and practical basis. The theoretical basis refers to the humanitarian, modest and limited nature of penalties; and the practical basis refers to the developed economic basis, the dualistic social structure between the political state and civil society, and the advanced social and cultural foundations.
