摘要
该文初步探讨了国际海上货物留置权的标的物是否必须为债务人所有的问题,认为《海商法》第87条的"其货物"应解释为运输的货物,同时对于无船承运业务下无船承运人和实际承运人的货物留置权问题进行分析,认为应赋予二者海上货物留置权,最后对无船承运业务下实际承运人的海上货物留置权的善意取得问题进行了探讨。
The paper discusses that whether the object of maritime lien should belong to the debtor.The author holds that the cargo stipulated in the maritime law should be interpreted as the transported cargo.As to the maritime lien in the non-vessel operation,the author believes that both of the nonvessel common carrier and the actual carrier should have the maritime lien right.Finally the author holds that it is not feasible to interpret the actual carrier's maritime lien by obtainment in due course.
