摘要
基于保证债务的从属性,保证人得主张主债务人享有的抗辩权、抵消权;基于保证责任的补充性,一般保证人可享有催告抗辩权和先诉抗辩权。保证与物保并存时,保证人不一定享有要求先执行物保的抗辩权。
Because of the dependency, Guarantor has debtor＇s right to defense, right ot rescission. According to the nature of complement, the common guarantor has ＂beneficium excussionis＂ and the right to defense named ＂cui-gao＂ . When creditor has the right of guarantee and security interest at the same time, guarantor not always has right to defense to make creditor perform the security interest first.
