摘要
商事经营场所租赁权是商事营业资产的重要构成要素,商人在行使商事经营场所的租赁权时应当受到法律的特别规范;一般租赁权的基本原则很少能够在经营场所租赁权中得到完全的适用;商事经营场所租赁权包括经营场所的使用权、转让权和续展权等,它们均具有不同于一般租赁权的特性。
The right to lease of commercial operation sites is a key factor in commercial operational capital, businessmen should be specially regulated by law in practicing right to lease of commercial operation sites; the basic principles in common right to lease can be rarely useful in right to lease of commercial operation sites. The right to lease of commercial operation sites includes the right to use, right to transfer and right of renewal of commercial operation sites, all of which have different nature from common right to lease.
