摘要
近年来,诉讼案件数量庞大与我国基层法院审判资源匮乏的矛盾异常突出,在现行合议制和独任制审判模式下,一方面是有限的优质资源的大量浪费,另一方面又让大量的不合格者充当裁判者的角色,严重影响了司法公正与效率的提高。而“二人制”审判模式能科学地配置审判资源,充分发挥不同层次资源的潜能,最大限度地提高审判效率,确保司法公正。因此,基层法院可以构建“二人制”审判模式。
In recent years, there is a lot of confradictions between large quantity of court cases and short of trial resources at grass-roots courts in our country. At present, because of the two trial ways of the collegiate system and the single system, the limited high qulity resources are wasted a lot, however many unqualified persons play the roles of judge. It influences the fair and efficiency of administration of justice. It is the purpose of ＂two-person system＂ trial way that we should distribute the trial resources reasonably, discover latent compacity of different resources, improve trial efficiency fully and insure the fair of administration of justice.
