摘要
提出《中华人民共和国物权法草案(三次审议稿)》既存在着“意思主义”规定,又存在着“债权形式主义”的规定。认为这种交错模式立法选择在理论上和实践上均存在缺陷,难以与相应的不动产登记制度相协调。建议立法应对两种模式进行权衡采纳其一。
The transference of real estate right is the important part of the real right law. There are different patterns of transference of real estate right in different countries. Both the autonomy of the will and the formalism of creditor's right can be found in the draft of the real right law. The author thinks that the adoption of two patterns can raise some problems both in theory and practice. It is also difficult to harmonize with the system of registration of real estate. So the author suggests that the real right law should choose either of them through assessment.
