摘要
我国物权立法在即,对于要不要设立居住权制度,学界意见仍不统一。本文通过对各国立法例和我国实际社会生活的考察,努力拓宽研究视野,找寻居住权更为重要的适用领域和立法需求,明确提出居住权绝不仅限于保护离婚妇女和保姆等社会弱势群体的“社会性”居住权,而且还包括现代社会所广为需求的“投资性”居住权。在拓展视野的基础上,作者对居住权的功能重新定位,变社会性居住权为社会性居住权与投资性居住权并存,使得居住权在传统的保护弱者的功能之外,具有更大的技术上的灵活性和适应性,以满足人们利用财产的形式上的多样性需求,更好地贯彻权利人的意志。在此认识基础上,对我国物权法(草案)中关于居住权的规定提出了进一步完善的具体方案。
China' s Property law will soon be legislated. Legal scholars, nonetheless, haven't reach the consensus concerning whether the Right of Inhabitation should be integrated into the legislation. This article explores the more widely and more important applicable fields of and social demand for the fight of inhabitation through the retrospection of worldwide legislations and the analysis of the reality of Chinese society. The author points out that the right of inhabitation does not only include the “right of inhabitation for the social purpose”, which can be used for the protection of those disadvantaged group such as divorced women and baby - sitters, but the “the right of inhabitation for the investment purpose”, which is seen as more widely useful for modem society. Based on such widened horizon, the function of the right to living is reoriented, converting from the singular right of inhabitation for the social purpose to the Integration of the right for investment purpose. This has made the right of inhabitation more flexible and applicable, thereby could better meet the demand of utilizing individual property with more varied means and more effectively convey the will of the property owner. The author proposes further the concrete scenario for the amelioration of stipulations concerning the right of inhabitation in the draft of China' s Property Law at the end of this article.
