摘要
通过对《韩国商法典》有关保险人代位求偿权的规定的介绍 ,并结合大量的韩国案例对《韩国商法典》规定的解释 ,较为详细地论述了韩国法下保险人代位求偿权的行使要件。
This article makes an analysis on the provision concerning subrogati on rights by insurers in Korean Commercial Code and covers some interp retation in Korean court decisions. It restricts its scope within the legal requ irements for exercising subrogation rights by insurers.
