摘要
反倾销是多边贸易体制所允许的进口救济措施之一,其宣称的目的应是抵消外国产品不公平竞争对国内产业造成的损害。但从反倾销在世界范围内不断扩展的过程中可以看出,反倾销实质上是进口国政府为保护国内产业而创造的一种新的贸易保护手段。随着关税、配额等传统贸易壁垒的削减,反倾销的使用频率不断提高,范围也不断扩大。而作为贸易自由化推动者的GATT/WTO并没有对反倾销的保护性予以有效地遏制,反而在法律上对反倾销的合理性给予了认可,为反倾销的泛滥提供了保障。
Antidumping is one of import remedy measures approved in the multi-literal trade mechanism.Its purpose should be claimed to mitigate the losses of the domestic industries incurred by the unfair competition of foreign goods.However,from the increasing expanding of antidumping in the world wide,we can see that in essence,antidumping is a new measure of trade protectionism the government of the importing country implements to protect its domestic industries.With the diminishing of the traditional trade barriers,such as tariffs,quotas,the measure of antidumping wins its increasing scope and frequency of practice.Yet GATT/WTO,the promoter of trade liberalization,didn't effectively hold back the protectionism of antidumping.Instead,it legally recognized the reasoning of antidumping,providing a shelter for the antidumping misuse.
