摘要
通过对案例实证分析发现,体育职务犯罪呈现以下特征:犯罪主体多元化、实权化;涉案场域广泛;作案手法多样、隐秘,窝案、串案多;取证、立案难,波及范围广,影响深远等。体育职务犯罪的形成和诱发原因主要有:道德意识和法制意识缺失引发的权力至上、金钱至上观作祟;职权过于集中,内部监管体系松散,外部监督机制冲突,以致监管乏力;缺少常规的司法介入机制。为了有效遏制体育职务犯罪频发的态势,需要从以下几个方面着手:在精神上感召让体育回归纯粹,重塑人们的体育道德意识;重点环节布控、切断体育黑金链条;建立多元化的司法介入机制。针对我国体育职务犯罪的司法介入应当重点考量介入主体、边界和路径等问题。
The empirical cases show that the sports duty crimes present some characteristics-the diversification of the subject of the crime which has the real power,they involved field widely,modus operandi is secret and various,the case string together more,it is difficult to collect evidence and put the case under review,they spread widely and they also will have a lot of negative impacts.The mental deterioration,the decline of morals,the lack of culture and the indifference of legal consciousness will make many people have the view that the power and money are more important than anything;the power is too concentrated,the internal supervision system is so loose that it cannot effectively,the external system is complex and disorganized,and the supervision mechanisms have many conflicts,all of these can lead to supervision out of control;and the lack of conventional judicial intervention mechanism,all of these facts are the main reasons for sports duty crimes.Therefore,in order to present the trend of the sports duty crimes from appearing frequently,it is necessary for us to let sports return to a pure world,control the key aspects,cut off the sports black key chain and establish the diversity of judicial intervention mechanism.We should consider problems that the main body,boundary and path of judicial intervention in view of our country.
