摘要
创新是经济增长的一个非常重要的因素,而产权对科学技术的创新及应用具有激励机制作用,对产权的保护则是促进创新的制度保障。因此,创新的商法保障机制就应该从产权保护着手,遵循从商自由的原则,保障私有产权的自由转让,同时贯彻促进交易快捷原则、维护交易安全原则。
Innovation is an important factor in economic development.Property right is an incentive for innovation in science and technology and for the application of innovations.Protection of property right is an institutional guarantee of promoting innovations.Therefore,business law’s safeguard mechanism should start from the protection of property right and follow the principles of free,easy,quick,and safe transfer of private property right.
