摘要
《刑事诉讼法修正案》在律师权利方面的修改重在保障犯罪嫌疑人的人权,体现在通过对律师会见和通信权、阅卷权、调查取证权等方面的修订,严格了操作规范,防止公权力被滥用。这些修订对侦查工作产生了重大影响,公安机关应深刻领会《刑事诉讼法修正案》的精神,正确看待律师权利的变化,在维护侦查权正当性的同时,保证诉讼活动的顺利开展。
The modification of the lawyers’ rights in the new amendment to the Criminal Procedural Law focuses on guaranteeing the human rights of suspects,which embodied the rights about the lawyers' meeting,communication,investigation,evidence collection,etc.It makes the operation regulations strict and prevents the abuse of public power.At the same time,these modifications have a significant impact on detection and also form a new challenge.Public security organs should deeply understand the spirit of the amendment,have a correct view of the changes in lawyers’ rights,ensure the smooth conduct of the litigation activities,and meanwhile maintain the legitimacy of the investigation right.
