摘要
运用文献资料、比较研究、逻辑分析等研究方法,对新修订的《中华人民共和国体育法》的国内外法治环境、修订背景、立法逻辑以及新旧条文变化等进行分析。研究发现,新修订的《体育法》是时代性、人民性和进步性的高度统一和集中体现,该法的全面修订具有深刻的历史背景和时代内涵,体现了以人民为中心的立法价值取向,强调人民的体育主体性地位,扩大公民体育权利范围并细化保障措施。此外,在重视体育精神、体育文化等国家体育软实力的提升,建立体育工作协调机制和体育执法机制以保障《体育法》有效实施,填补青少年体育、体育产业、体育仲裁等制度空白,强化对反兴奋剂、体育腐败的治理等方面,体现了新修订的《体育法》的制度创新和立法进步。
Through the use of research methods such as literature review,comparative study,and logical analysis,it was found that the newly revised Law of the People’s Republic of China on Physical Culture and Sports reflects a high degree of unity and concentration on epochal nature,affinity to the people,and progressiveness in terms of its domestic and foreign legal environment,revision background,legislative logic,and changes in the new provisions.The comprehensive revision of the Law of the People’s Republic of China on Physical Culture and Sports has a profound historical background and connotation of the times,embodies the people-centered legislative value orientation,emphasizes the people’s sports subjective status,expands the scope of citizens’sports rights and refines measures of safeguard.The newly revised Sports Law reflects the institutional innovation and legislative progress in many aspects,such as emphasizing the improvement of sports soft power of sports spirit and sports culture in China,establishing a sports work coordination mechanism and sports law enforcement mechanism to ensure the effective implementation of the Sports Law,filling the gaps in youth sports,sports industry,sports arbitration,etc.,strengthening governance of anti-doping and sports corruption,etc.
