摘要
实证研究发现,法院在定罪阶段对袭警罪采取了扩张适用的态度;在量刑阶段对从重处罚情节尽量限制适用,而对从轻处罚情节则宽松适用,以便实现刑罚的轻缓化。在实务认定中,袭警罪的基本款以及加重款的构成要件都存在一定程度的认定分歧。袭警罪的保护法益是警察的公务以及人身安全。袭警罪基本款中的暴力袭击的是指足以危害警察人身安全的行为;执行职务的时间范围,不仅包括执行开始到结束这一狭义的时间段,而且包括与执行行为本身一体的、不可分的时间段;执行职务的合法性判断,需要同时兼顾实体要件与程序要件;人民警察的范围应当包括警察的辅助人员。在认定“严重危及其人身安全”时,应当重点考察行为是否对警察人身安全造成了严重的具体危险。
The empirical study found that the people’s Court adopted the attitude of expanding the application of the offence of the assaulting police in the conviction stage;In the sentencing stage,the application of heavier punishment circumstances is limited as much as possible,while the application of lighter punishment circumstances is relaxed,to realize the mitigation of punishment.In practice,there are some differences in the identification of the basic section and the constituent elements of the aggravated section of the offence of assaulting police.The protection legal interest of the offence of assaulting police is the official duty and personal safety of the police.The violent attack in the basic section of the offence of the assaulting police refers to the behavior that is enough to endanger the personal safety of the police;The time range of performing duties includes not only the narrow time period from the beginning to the end of the performance,but also the integral and inseparable time period with the performance itself;The judgment of the legitimacy of performing duties needs to take into account both substantive and procedural elements;The scope of the people’s police shall include auxiliary personnel of the police.When determining“seriously endangering the personal safety of the police”,we should focus on whether the behavior poses a serious specific danger to the personal safety of the police.
