摘要
近年来,部分法院民事执行权在运行过程中被强化、扩张,导致权力运行失范现象频发。对此,法院自身的纵向监管乏力、收效不佳。检察机关有必要充分发挥民事检察监督的作用,力促法院民事执行权正当运行。结合D县检察院和其他检察机关的探索进行理性思考,建议从以下几个方面优化民事执行检察监督工作,一是建立民事执行监督告知制度,保障当事人知情权,二是建立法检沟通协作机制,共筑民事执行共同体,三是丰富监督手段与工具,提升检察监督效果,四是强化队伍建设,提升检察监督专业性,五是以人民为中心,积极促成和解,六是加强顶层设计,保障检察监督持续性。这样才能全面提升基层民事执行检察监督的质量和效果。
In recent years,the civil enforcement power of certain courts has been strengthened and expanded during its operation,leading to frequent occurrences of irregularities in power execution.The internal vertical supervision within the courts has proven inadequate and ineffective in addressing these issues.It is essential for the procuratorial organs to fully exercise their civil enforcement supervision function to ensure the proper operation of civil enforcement power by the courts.Based on a rational analysis of the practices of the D County Procuratorate and other procuratorial organs,the following recommendations are proposed to optimize civil enforcement supervision:First,establish a notification system for civil enforcement supervision to safeguard the parties'right to information.Second,develop a communication and cooperation mechanism between the courts and procuratorates to build a civil enforcement community.Third,diversify supervision methods and tools to enhance the effectiveness of prosecutorial supervision.Fourth,strengthen the capacity building of supervision teams to improve the professionalism of prosecutorial supervision.Fifth,adopt a people-centered approach to actively promote reconciliation.Sixth,enhance top-level design to ensure the continuity of prosecutorial supervision.These measures are crucial for comprehensively improving the quality and effectiveness of civil enforcement supervision at the grassroots level.
