摘要
从反垄断法在互联网经济领域的生效情况来看,目前仍然存在着力不从心的状况。由于互联网经济具有虚拟性、外溢性等特征,导致反垄断法体系很难及时检测到互联网经济平台上的垄断因子。为了促进我国反垄断法的完善,推动反垄断法对互联网经济的规制,提出一种垄断法经济学模型,并在该模型下分析当前互联网经济对我国现行反垄断法造成的挑战。针对挑战因素提出全新建议,最终有效促进我国反垄断法对互联网经济的规制,减少互联网经济领域出现的垄断现象。
Given the effectiveness of antitrust laws in the field of the internet economy,there still exists a situation where the laws are insufficiently effective.Due to the characteristics of the internet economy,such as its virtuality and spillover effects,the antitrust legal framework struggles to promptly identify monopolistic factors on internet economic platforms.In order to promote the perfection of anti-monopoly law in our country,as well as enhancing the regulation of the internet economy,the paper primarily proposed an antitrust economics model,under which the study analyzed the challenges posed by the current internet economy to China’s existing antitrust laws.In consideration of challenge,the paper proposed new suggestions to ultimately effectively strengthen the regulation of the internet economy by China’s antitrust laws and reduce monopolistic phenomena in the sector.
